What if my employer appeals a WSIB decision?If you think your employer’s could stop you from getting benefits, you should participate.
If you have already received benefits, the Workplace Safety and Insurance Board (WSIB) can only make you pay them back if you:
- didn’t tell the truth about your injury claim
- didn’t tell the WSIB within 10 days about important changes to your health, abilities, income, job status, or availability to return to work that could affect your rights to benefits
- didn’t give back benefits that you knew you shouldn’t have got
Even if you are back at work after receiving benefits, your employer’s appeal could impact your ability to get benefits in the future.
For advice about whether or not you should participate in your employer’s appeal, you can speak to:
- your representative
- a representative of the Office of the Workers’ Advisor (OWA)
