3. Give your Application for Review to the Labour Board

Give a signed original copy and another copy of your Application for Review with the Ontario Labour Relations Board (Labour Board). This is called “filing” your application.

Make sure you have completed the Certificate of Delivery. Don’t forget to keep your own copy.

You must file your application with the Labour Board within 5 days of giving a copy to your employer and the Director of Employment Standards. Weekends, public holidays, or any day the Board is closed don’t count as part of the 5 days.

So, for example, if you give copies to your employer and the Director of Employment Standards on Wednesday, October 21, the last day to file your application with the Labour Board is Wednesday, October 28, 2015.

Remember that you should also file with the Labour Board within the time limit of 30 days from the date you got the ESO’s decision.

You can file your application with the Labour Board by courier or deliver it yourself. Their address is:

If you don’t file in time, the Labour Board might not consider your application.

If you file everything on time, the Labour Board sends you a letter to say they received your application.
