1. Fill out the Application for Review form

The Ontario Labour Relations Board (Labour Board) has a form you use to ask them to review a decision made by an Employment Standards Officer (ESO) from the Ministry of Labour. The form you use is Form A-103 – Application for Review.

In Part I, check off that you’re applying as an employee who objects to an ESO’s order or to an ESO refusing to make an order.

In Part II, you include your full name, address, phone number, and email address.

In Part III, you include your employer’s full name, address, phone number, and email address.

In Part IV, you check off and include a copy of the ESO’s report, the decision letter from the Ministry of Labour, and the order, if one was made.

In Part V, you give the reasons for your application. For example, you can say:

  • what rules your employer broke, when, and how much they owe you
  • what you want the Labour Board to do, for example, order your employer to pay you money or give you your job back
