1. Find out if you’re eligible

You may be able to serve your sentence on weekends if your sentence is for 90 days or less. An intermittent sentence is not a right. It’s up to the judge to decide if you should have one based on your case.

When deciding whether to give you an intermittent sentence, the judge considers:

• your age and character
• the nature of the crime you were found guilty of
• the circumstances at the time of the crime
• whether you have somewhere to live that will allow you to follow the terms of your sentence
