En cas d’arrestation, ne résistez pas<\/u>. La police vous arrêterait quand même, et vous risqueriez d’être accusé d’entrave à un agent de la paix, de voies de fait contre un agent de la paix ou de voies de fait avec intention de résister à l’arrestation.<\/p>\n

Arrestation illégale<\/h3>\n

Selon le Code criminel<\/em><\/a>,<\/em> vous avez le droit de résister à une arrestation si elle est illégale. En effet, vous pouvez prendre des moyens raisonnables pour vous défendre si la police vous menace ou emploie la force illégalement. Toutefois, vous ne pourrez pas l’empêcher de vous arrêter.<\/p>\n

Si vous croyez avoir fait l’objet d’une détention ou d’une arrestation illégale, vous pourrez demander réparation pour la violation de vos droits plus tard, avec l’aide d’un avocat. <\/p>\n

C’est le tribunal qui déterminera si votre arrestation était illégale ou non. S’il juge qu’elle était illégale,<\/strong> alors vous étiez en droit de résister.<\/p>\n
