Pr\u00e9parez-vous \u00e0 l\u2019audience"},"content":{"rendered":"<p>La Commission vous enverra un avis d&rsquo;audience qui pr&eacute;cisera la date, l&rsquo;heure et le lieu de l&rsquo;audience.<\/p>\n<h3>Rassemblez les &eacute;l&eacute;ments de preuve<\/h3>\n<p>La Commission rend sa d&eacute;cision en fonction de la preuve pr&eacute;sent&eacute;e &agrave; l&rsquo;audience. Les renseignements inclus dans votre requ&ecirc;te <strong>ne constituent pas<\/strong> des &eacute;l&eacute;ments de preuve.<\/p>\n<p>Vous devez d&eacute;montrer&nbsp;:<\/p>\n<ul>\n<li>que par sa fa&ccedil;on d&rsquo;agir, votre employeur a port&eacute; atteinte &agrave; vos droits pr&eacute;vus dans la <em>Loi sur les normes d&rsquo;emploi<\/em>;<\/li>\n<li>qu&rsquo;en raison de ce comportement, vous avez perdu de l&rsquo;argent ou &eacute;t&eacute; l&eacute;s&eacute; d&rsquo;une autre mani&egrave;re.<\/li>\n<\/ul>\n<p>Pour d&eacute;montrer ces faits, vous devez pr&eacute;senter des &eacute;l&eacute;ments de preuve &agrave; l&rsquo;audience.<\/p>\n<p>Cette preuve peut prendre les formes suivantes&nbsp;:<\/p>\n<ul>\n<li>t&eacute;moignages de personnes qui racontent ce qu&rsquo;elles savent des &eacute;v&eacute;nements ou expliquent les r&eacute;percussions de ceux-ci sur votre vie;<\/li>\n<li>documents (p.&nbsp;ex., lettres ou courriels) provenant de l&rsquo;employeur.<\/li>\n<\/ul>\n<p>Les &eacute;l&eacute;ments de preuve que vous choisissez de pr&eacute;senter peuvent &eacute;galement prendre d&rsquo;autres formes. Il peut notamment s&rsquo;agir de photos, de vid&eacute;os ou d&rsquo;enregistrements audio qui vous aideront &agrave; &eacute;tablir le bien-fond&eacute; de votre requ&ecirc;te. La personne qui a pris la photo ou fait l&rsquo;enregistrement doit compara&icirc;tre &agrave; l&rsquo;audience.<\/p>\n<h3>Respectez les r&egrave;gles<\/h3>\n<p>La Commission dispose de <a class=\"links-link ext new-link\" href=\"\/node\/113420\" target=\"_blank\">r&egrave;gles<\/a> pr&eacute;cises sur l&rsquo;information &agrave; fournir &agrave; propos de votre preuve avant l&rsquo;audience. Si vous ne suivez pas ces r&egrave;gles, la Commission peut refuser de tenir compte de votre preuve ou rejeter votre requ&ecirc;te sans audience.<\/p>\n<h3>D&eacute;cision<\/h3>\n<p>En g&eacute;n&eacute;ral, la Commission rend sa d&eacute;cision apr&egrave;s l&rsquo;audience et vous envoie une copie &eacute;crite de celle-ci par la poste.<\/p>\n<p>Cette d&eacute;cision est g&eacute;n&eacute;ralement d&eacute;finitive.
